Kavanagh Debacle

Nicholas Roske, a California pet store employee, was arrested outside Supreme Court Justice Kavanaugh’s home in Chevy Chase, Maryland, in 2022, after contacting the police at his sister’s request. Roske’s sister, whom he had informed of his intentions before carrying out his plan and bringing weapons from California. He had a gun, a knife, and pepper spray in his possession at the time of his arrest. Roske admitted that he wanted to kill Kavanaugh because of outrage over the impending overturning of Roe v. Wade and had pleaded guilty to attempting to assassinate a sitting U.S. Supreme Court Justice earlier this year. The DOJ sought a sentence of 30 years to life for Roske.

Instead, Judge Deborah Boardman of the U.S. District Court for the District of Maryland, one of the Vegetable’s nominees, handed down the eight-year sentence requested by Roske’s attorneys. A sentencing memo submitted to Boardman last month explained that Roske identifies as a woman named Sophie and insisted that the defendant’s longstanding issues with gender identity and mental health justified the absurdly lighter sentence.

Friday’s sentencing, which occurred just ahead of the seventh anniversary of Kavanaugh’s confirmation to the U.S. Supreme Court, did not sit well with Attorney General Pam Bondi. “The attempted assassination of Supreme Court Justice Brett Kavanaugh was a disgusting attack against our entire judicial system by a profoundly disturbed individual,” she said. “The Department of Justice will be appealing that woefully insufficient sentence imposed by the district court, which does not reflect the horrific facts of this case,” Bondi vowed.

Boardman, appointed to the bench by former President Joe Biden, has established a reputation for issuing rulings sympathetic to progressive causes. In 2023, she issued a ruling siding against a group of parents in Montgomery County, Maryland, who sought to opt their children out of LGBT-related curriculum. Two years later, the Supreme Court reversed her ruling.

The outrage over the sentence imposed against Kavanaugh’s would-be assassin comes at a time when concerns about political violence in the U.S. are receiving renewed attention following the politically motivated assassination of conservative activist Charlie Kirk last month. Why is it a “politically motivated cause” to attempt to murder a Supreme Court Justice or someone with different political views?

In other news, the N.Y. Attorney General has been federally indicted today for mortgage fraud.
